1. Buyer's Premium & Payment Terms

A 20% Buyer's Premium will be added to all winning bids to determine the final purchase price.

Primary Payment Method: Unless prior arrangements are made, the credit card on file with HiBid will be charged automatically at the close of the auction.

Alternative Payment Methods: Cash, wire transfer, cashier's check, or money order may be accepted only if approved prior to auction closing.

Credit Card Limits & Requirements:

Invoices over $500 paid by credit card require buyer verification.

Buyers must email a copy of their driver's license and written approval prior to processing.

Invoices over $1,500 must be paid by wire transfer. Credit cards will not be accepted for balances exceeding this amount.

A 3% processing fee applies to all credit card payments.

Wire Transfer Fee: A $25 wire transfer fee applies to all wire payments.

Payment Deadline: All invoices must be paid in full prior to item removal and no later than the designated pickup deadline.

No-Show / Non-Payment: A $25 no-show fee may be charged if payment is not received by the pickup deadline.

Final Sale: All sales are final. No refunds, returns, or exchanges.

2. Auctioneer's Rights & Discretion

Harris Real Estate & Auction reserves the right to add, delete, edit, combine, subdivide, or re-catalog lots at any time prior to auction closing.

The auctioneer may modify sale dates, times, or details in the event of technical issues, weather, or emergencies.

The auctioneer reserves the right to accept or reject any bid for any reason.

Harris Real Estate & Auction employees and associates may bid for themselves or on behalf of absentee or proxy bidders.

All accepted bids constitute a legally binding contract between the bidder and seller.

All lots are sold subject to seller confirmation unless otherwise announced as absolute.

3. Pickup, Loading & Removal

PICKUP DATE: Friday, October 23, 2026

PICKUP TIME: 10:00 AM–2:00 PM CDT

PICKUP LOCATION: 775 Meridian Road, Hickory, KY 42051

All purchased items must be paid for in full prior to pickup.

Buyers are solely responsible for rigging, loading, dismantling, securing, transporting, and unloading purchased items.

Harris Real Estate & Auction does not provide labor or equipment for loading and assumes no liability for injuries, damages, or losses during removal.

Buyers must verify all purchased items are present before leaving the pickup location.

Items not removed during the designated pickup period will be considered abandoned and forfeited without refund unless prior arrangements have been approved by Harris Real Estate & Auction.

4. Shipping

LOCAL PICKUP ONLY – NO SHIPPING AVAILABLE.

All items must be picked up at the designated auction location during the scheduled pickup period.

Buyers are responsible for arranging transportation and removal of all purchased items.

5. Sales Tax & Exemption

Applicable sales tax will be collected unless a valid exemption form is provided.

To claim exemption, bidders must email a completed exemption form to online@harrisauctions.com prior to auction closing.

A separate exemption form must be submitted for each auction event.

6. Property Condition & Inspection

ALL PERSONAL PROPERTY IS SOLD "AS IS, WHERE IS," WITH NO WARRANTIES OR GUARANTEES, EXPRESSED OR IMPLIED.

Descriptions and photographs are provided in good faith. However, Harris Real Estate & Auction makes no representations or warranties regarding the accuracy, completeness, authenticity, functionality, or condition of any item.

It is the bidder's responsibility to inspect items in person or carefully review photographs and descriptions before placing bids.

PUBLIC PREVIEW: Monday, October 19, 2026 from 4:00–5:00 PM CDT at 775 Meridian Road, Hickory, KY.

Buyers are encouraged to inspect items during the scheduled preview.

By placing a bid, the bidder acknowledges having had the opportunity to inspect the property and accepts the item's condition.

All sales are final.

7. Bidding Process & Auction Closing

All bidders must be at least 18 years of age and maintain an active HiBid account with a valid credit card.

Bidding will begin closing Wednesday, October 21, 2026 at 2:00 PM CDT.

Any bid placed within two (2) minutes of a lot's scheduled closing time will extend bidding on that lot by two (2) minutes.

Outbid notifications may be sent by email; however, Harris Real Estate & Auction is not responsible for delays or failures in email delivery.

Bidders are encouraged to monitor auction closings or place maximum bids to ensure participation.

Bidding increments are automatically established by the auction software.

8. Default & Collection

If purchases are not paid for and removed by the specified deadline, the bidder will be considered in default.

Defaulting bidders may be blocked from future auctions, and unpaid items may be offered to the next highest bidder or resold.

The defaulting bidder shall be liable for any loss incurred upon resale, including but not limited to price differences, additional fees, storage, advertising, labor, and administrative costs.

The bidder agrees to pay all reasonable attorney's fees, collection costs, and expenses incurred in enforcing payment obligations.

By bidding, the bidder personally guarantees payment and performance, even when bidding on behalf of a business or other entity.

9. Liability Limitation

Harris Real Estate & Auction's total liability is limited to the return of funds paid for items not delivered at pickup.

Harris Real Estate & Auction and its employees, agents, and representatives shall not be liable for consequential, incidental, or indirect damages arising from the auction, bidding process, or removal of purchased items.

10. Bidder Responsibilities & Conduct

Bidders are responsible for maintaining the confidentiality of their usernames and passwords and for all activity conducted under their accounts.

Offensive or inappropriate usernames may be altered or removed.

Bidders agree to comply with all applicable local, state, and federal laws.

By registering and bidding, bidders authorize Harris Real Estate & Auction to charge their registered credit card for purchases and applicable fees.

Bidders waive the right to a jury trial, agreeing that disputes shall be resolved before a judge in a court of competent jurisdiction.

11. Acknowledgment

By registering, bidding, or participating in this online auction, bidders acknowledge that they have read, understand, and agree to be bound by all Terms & Conditions stated herein.
